About WiseChat

WiseChat is a Software as a Service (SaaS) product designed to boost your productivity and knowledge management. Our platform allows users to index content that they provide from various sources, including but not limited to platforms like Google Drive.

Advanced Language Processing with LLMs

WiseChat employs Large Language Models (LLMs) for better indexing and retrieval of your content. As of now, we utilize the OpenAI API as an example of such models, with plans to integrate more LLMs in the future. These models assist in effectively understanding and categorizing your content, ensuring more precise query results.

Your Data, Sharing, and LLMs

Your data’s safety and integrity are paramount to us. When you provide content, it’s processed by the LLM to enhance search capabilities. It’s important to note that while we utilize the capabilities of these models, we adhere to their data protection guidelines. Specifically, with OpenAI, we ensure that the data shared doesn’t contribute to training their models. If you have concerns about how the models handle data, we recommend reviewing the data protection guidelines of the respective LLM providers.

Accuracy and Limitations

LLMs, though advanced, have their limits. You might occasionally come across inaccuracies or outputs that may not seem entirely relevant. However, our commitment remains steadfast in refining our system, ensuring it meets your expectations.

3. Payment Terms

WiseChat offers a tiered pricing structure to cater to different user needs. We offer a free tier that allows up to 50 messages per month. For users who require more extensive use of our services, we offer additional plans with more features. These plans are available for a fee, which can be paid via PayPal or Stripe. If a payment fails, the account may be suspended until the issue is resolved. We strive to provide clear and fair pricing, and we will always notify you in advance of any changes to our pricing structure.

4. Account Registration and Security

To use WiseChat, you will need to register an account with us. During the registration process, you will be asked to provide certain information, including your company information, credit card information for Stripe, user name, password, first name, and last name. We take your privacy and security seriously. We store account information in the EU with Hetzner, a reputable data center operator. All data transmission is secured using SSL encryption to protect your information from unauthorized access.

5. User Conduct

As a user of WiseChat, you are expected to use our services responsibly and in compliance with all applicable laws and regulations. This includes not using our services to index or generate pornographic, violent, or otherwise illegal content. We reserve the right to issue warnings or suspend accounts without a refund if we find that a user has violated these rules. We believe in maintaining a safe and respectful environment for all our users, and we appreciate your cooperation in upholding these standards.

6. Intellectual Property Rights

We respect the intellectual property rights of our users. As such, users retain ownership of the content they generate with our service. This means that you are free to use the content generated through WiseChat for your own purposes, without any requirement to attribute it to WiseChat. However, please note that by using our services, you grant us a license to use your content to the extent necessary to provide our services. We will not use your content for promotional purposes. Companies that use our service may be used as references on our website for promotional purposes.

7. Data Privacy

At WiseChat, we are committed to protecting your privacy and handling your data in an open and transparent manner. We use servers located in the EU and comply with the General Data Protection Regulation (GDPR). Users are responsible for ensuring that the documents they use comply with GDPR, as we send these documents to the OpenAI API. We retain data as long as the user stays with us. We may use user queries and answers to give better answers in the future. User’s data is deleted 30 days after account termination.

8. Access to Third-Party Services

In order to provide our services, WiseChat may need to connect with third-party APIs, such as Google API. By using our services, you grant us permission to access your documents through these APIs for the purpose of indexing them and using them to answer your questions with the ChatGPT API. We will handle all data accessed in this way in accordance with our privacy policy and applicable laws. Please ensure that any documents you allow us to access in this way do not contain sensitive or private information unless necessary for the use of our services.

9. Limitations of Liability and Disclaimer of Warranties

While we strive to provide a reliable and efficient service, we cannot guarantee that our services will be available 100% of the time. We ensure the availability of our servers at 93% on an annual average. We are not liable for issues beyond our control such as internet outages or server failures. If services are inaccessible for more than 48 hours consecutively or 72 hours per month, we will provide a 25% discount for that month upon request. Further claims are excluded unless we have acted intentionally or with gross negligence.

10. Termination

We value our relationship with our users, but we also reserve the right to terminate a user’s account under certain circumstances. This includes, but is not limited to, violation of our user conduct rules or failure to pay for our services. Upon termination, we will handle user data in accordance with our privacy policy and applicable laws. We will make reasonable efforts to notify users in advance of any planned termination of their account. User’s data is deleted 30 days after account termination.

11. Dispute Resolution

We strive to resolve any issues or disputes that arise in the course of using our services amicably and professionally. We encourage our users to contact us first if they have any concerns or complaints. However, in the event that a dispute cannot be resolved through mutual agreement, such disputes will be resolved in the Berlin court. By using our services, you agree to this jurisdiction for the resolution of any disputes. This applies to all users, regardless of their location.

If you’re not happy with the way we’ve handled your complaint, the European Commission provides a platform for online dispute resolution (ODR), which you can access here: https://ec.europa.eu/consumers/odr. You can use this platform to resolve disputes arising from online transactions. Please note that this does not deprive you of your right to bring proceedings against us in the courts of Berlin, Germany.

12. Updates to the Terms of Service

We may occasionally update these Terms of Service to reflect changes in our services, user feedback, or changes in law. We will notify users of any significant changes to these Terms of Service via email one month in advance. If a user does not agree to these changes, they have the option to terminate their account.

13. Applicable Law

These Terms of Service, and any disputes arising out of or in relation to them, are governed by German law. By using our services, you agree to the application of German law in all matters related to our services.

14. Additional Provisions

We reserve the right to permanently delete a user’s account one week after the expiry of the paid version and to remove all previously stored customer data. We are entitled to use the logo, brand name, and company name of the customer and the domains or companies stored in the account free of charge for advertising purposes. We reserve the right to change or supplement these Terms and Conditions, provided that the customer agrees to do so. The customer will be informed of planned changes to the Terms and Conditions in text form at least one month before the planned date of change. The customer’s consent shall be deemed to have been given if they do not object within one month of receipt of the notification of the change or addition.
